Music Downloader Appeals $67.5K Award, Calls It ‘Equally as Insane’ as Earlier $675K Verdict
Posted: August 25th
A Boston University physics graduate student has announced that he will appeal a reduced $67,500 award for downloading copyrighted music, calling the amount "equally as insane" as the $675,000 jury verdict he originally faced after a federal trial last year. Joel Tenenbaum, 26, says he will have to declare bankruptcy if the $67,500 award is upheld by the Boston-based 1st U.S. Circuit Court of Appeals, reports the Metro Desk blog of the Boston Globe. He is represented by professor Charles Nesson of Harvard Law School, who has filed a notice of appeal with the 1st Circuit. Earlier coverage: ABAJournal.com: "Judge ...

9th Circuit Allows Televangelist’s Suit Against ‘20/20’ for Out-of-Context Film Clip
Posted: August 25th
A federal appeals court is allowing a televangelist’s defamation suit claiming ABC’s 20/20 news program took a clip of one of his sermons out of context. On Tuesday, the San Francisco-based 9th U.S. Circuit Court of Appeals reinstated the suit by the Rev. Frederick Price, who preaches a "prosperity gospel" in televised sermons, according to the Associated Press and the San Francisco Chronicle. The TV news magazine broadcast a film clip showing Price delivering a sermon in which he says: "I live in a 25-room mansion. I have my own $6 million yacht. I have my own private jet, and ...

Patient Rights Pitted Against Civil Rights in Nursing Home Bias Case
Posted: August 25th
An Indiana patient rights law led one Indiana nursing home to go along with the wishes of a resident who specified she wanted only white caregivers. The law says patients can choose their "providers of services" and nursing homes must reasonably accommodate residents’ preferences, the Associated Press reports. Plainfield Healthcare Center allowed patients to dictate the race of their certified nursing assistants, noting on the daily assignment sheet for one of its black workers, Brenda Chaney, that one resident "prefers no black CNAs." Chaney eventually challenged the practice and won a ruling last month by the Chicago-based 7th U.S. Circuit ...

Another reason why radicals believe that their goals justify criminal means, and also why they can be relied on to lie and steal and, in the right context, either commit actual murder or justify murders when committed by their political friends, is because in their own minds they are engaged in a war for "social justice" and other noble ends, and are opposed by an enemy who is an implacable oppressor, in fact, the embodiment of evil. In war, when one’s own survival is at stake, any means can seem both attractive and necessary. Radicals think of themselves as soldiers in a war to save mankind — and to save the planet. If that is your responsibility and aim, quibbling over the means to accomplish those objectives can easily come to seem immoral itself.
